Seattle Environmentally Critical Areas: An Early Project Checklist

Seattle maps a set of environmentally critical areas: steep slopes, ground with a known landslide history, wetlands, creeks and their buffers, shorelines, flood-prone land, and in some cases the trees and vegetation holding all of it together. If one of them touches your lot, the designation almost never decides whether you can build. It decides three other things, and they are the things that reorder a project.

It decides where the work can physically go. It decides what has to be studied, by whom, before anyone commits to a drawing. And it decides the sequence, because the study has to inform the design rather than justify it after the fact.

Homeowners usually meet an environmentally critical area at the worst possible moment: after the floor plan is settled, when the permit set is being assembled and someone finally looks at the slope behind the house. Meeting it earlier costs almost nothing. Meeting it late costs a redesign.

What the designation actually changes

It moves the governing document from the floor plan to the site plan

A floor plan describes the finished building. A critical-area review is about everything else: how the ground gets excavated, where the spoil goes, how water leaves the site during and after construction, which trees survive the access route, and how close any of that comes to the regulated feature. A perfectly reasonable addition can be unbuildable as drawn and entirely buildable ten feet to the north.

That is why the site plan, not the elevation, is the document that decides a critical-area project.

It requires engineered input, not paperwork

The most common misunderstanding is that a critical-area flag adds a form. It adds a professional. Depending on the condition, that is a geotechnical engineer, a licensed surveyor, an arborist, a wetland or shoreline specialist, or a civil engineer for drainage.

Their output is not a permission slip. A geotechnical report specifies the foundation: how deep, on what, with what drainage and what shoring during excavation. That specification typically arrives before the structural design is finished, because the structure depends on it. Ordering it late is what turns a two-week question into a three-month one.

It regulates disturbance, not just the building footprint

The regulated area is the area you disturb, which is almost always larger than the thing you build. Excavation slopes back. Equipment needs to reach the work. Material has to be staged somewhere. A small detached unit can easily disturb two or three times its own footprint once access, trenching and staging are counted.

This is the single most common surprise on a sloped Seattle lot, and it is worth listing the temporary work separately from the permanent work at the start.

It changes what counts as "just site prep"

Clearing brush, taking down a tree, demolishing a garage and rough grading feel like preparation rather than construction. Inside a critical area they are frequently the regulated activity. SDCI's construction-without-a-permit guidance is explicit that work in environmentally critical areas can require permits, and that unpermitted work can draw stop-work orders and penalties.

A stop-work order on a slope in October is not a paperwork problem. It is a winter of exposed soil.

Where this shows up on Seattle lots

Steep and slide-prone ground. A lot of Seattle's hillside housing stock sits on it. The practical effects are a deeper or pinned foundation, engineered drainage that has to discharge somewhere legal, temporary shoring during excavation, and a construction window that is narrower than the calendar suggests. None of these are unusual and all of them are expensive to discover after pricing.

Trees. A protected tree does not only restrict what happens to the tree. Its root protection zone restricts what happens to the ground under it, which routinely means the driveway, the utility trench or the staging area. Moving a building three feet is cheap. Moving it after the foundation is priced is not.

Water. Creeks, wetlands, shorelines and their buffers work on distance from the feature, and the boundary itself often has to be delineated by a specialist before anyone can say where the buildable area starts. On these lots the first real number in the project is the delineation, not the estimate.

Drainage. Even away from a mapped feature, a lot that concentrates runoff onto a neighbor or into a slide-prone area will attract review. Solving it is usually detention, dispersion or a tightline, all of which are civil work that belongs in the budget from the beginning.

What it means by project type

Interior remodel. Often unaffected, right up until the scope includes foundation work, an exterior excavation, a new opening, utility trenching or a change to how water leaves the site. Describe the work by what gets dug, not by the word "remodel."

Addition. An addition creates a new footprint, which means excavation, foundation and drainage questions at exactly the line where old and new meet. That junction plus the temporary work zone is what gets screened. Our home additions work starts from the site conditions for this reason.

ADU or DADU. A detached unit brings its own foundation and its own utility runs, and the route between the street and the building site is part of the project. Small building, larger disturbance. If a backyard unit is what you are considering, the site screening belongs at the front of the ADU and DADU construction conversation, before a layout exists to defend.

New home. Broad site planning, demolition, grading, utilities and access all at once. Keep the concept loose until the site-specific constraints are known, because on a critical-area lot the site usually wins the argument.

What a designation does not mean

It does not mean no. Most critical-area projects in Seattle get built. What changes is that the site gets a vote, the study comes before the design, and the honest cost and schedule appear later than a homeowner would like.

The failure case is not the designation. It is a design produced in ignorance of it, priced on that design, and then rebuilt twice. SDCI's permit-process guidance notes that a pre-application site visit can surface drainage, tree, property-line and ground-disturbance issues, and it is worth using that early rather than discovering the same issues in plan review.

Screening a lot for critical areas is a short piece of work. Redesigning around one is not.
